Educate at home: the third way
sevillanas Twenty families choose to teach their children out of school • The Court gives the right to parents who choose this system, although the Board has not recognized as such
J. DIEGO Geniz home, an option already chosen by a score of Seville parents who have decided to charge themselves the education of their children without resorting to the traditional system. This alternative, however, is not yet recognized by the government (including the Board), some of which have sat on the bench of the court to several families who have opted for that option. Justice, for now, has the right to parents.
Home schooling has taken a long boom in Andalusia in the last decade. Some scholars place the origin of this type of education in the late nineteenth century, when publications appear like Mary Montessori in which it insists on the need for an individualized approach to student education and the teaching object. Other theorists, even put the most immediate precedent to the Free Institution of Education with his defense of academic freedom at the university level, extrapolated to earlier stages. The fact that free education is gaining adherents every year, so that in Spain there are currently over 400 families who opt for this system, a score of them in the province of Sevilla.
The main problem faced by these parents is the legal vacuum that exists in this regard. There is no law regulating home schooling, but also that the ban. For this reason, those who choose to teach their children in the family have to resort to the defense of superior standards and the General Principle of Permission, whereby everything that is not expressly prohibited is considered permissible, and the English Constitution, Article 27 recognizes the freedom of education. Moreover, the supreme law stipulates that fundamental rights and freedoms recognized therein shall be construed in accordance with the Universal Declaration of Human Rights, including freedom of the parents preferred to choose the kind of education that shall be given for their children.
Despite this support, government have reported several families at home who teach their children to understand that these are cases of truancy. However, in all justice has ended up giving the reason parents. In the province of Seville to find a recent case must go back to 1998, when the Audiencia de Sevilla said in a ruling that they are excluded from the offense all cases in which the child receives the appropriate training, although it is carried out in the family home.
One of the voices that have been shown for this system is the Defesor del Pueblo Andaluz, José Chamizo, who in 2003 said that home schooling is not an event but a school truancy "Alternative." Chamizo stresses the need to legislate this situation so that the child will be learning recognized by a school or the inspectorate of the Education Authority. Given this lack some parents enroll their children in a distance to get the graduate school.
There is no set age that children leave the system to be integrated into the traditional, but most often do so at 12 years, coinciding with the start of their school time in high school. However, there are parents who continue education at home to the University, thanks in part to the possibility of obtaining the qualification for free at ESO.
